These terms and conditions (the "Terms and Conditions") govern the use of www.cherrylamvoice.com (the "Site").  This Site is owned and/or operated by Cherry Lam Voice ("we/us").  This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

A. Intellectual Property

All content published and made available on our Site is the property of Cherry Lam Voice and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

 

B. Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

 

• Harass or mistreat other users of our Site;

• Violate the rights of other users of our Site;

• Violate the intellectual property rights of the Site owners or any third party to the Site;

• Hack into the account of another user of the Site;

• Act in any way that could be considered fraudulent; or

• Post any material that may be deemed inappropriate or offensive.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

 

C. Accounts
 

When you create an account on our Site, Acuity Scheduling or Stripe, you agree to the following:

1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

 

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

 

D. Sale of Services

These Terms and Conditions govern the sale of services available on our Site, Acuity Scheduling or Stripe.

We are under a legal duty to supply services that match the description of the service(s) you or your parent/guardian ("you/the Client") order on our Site, Acuity Scheduling or Stripe.

The following services are available:

• 1-to-1 singing lessons

• Group lessons

• Estill Voice Training practice groups/course​

​

These Terms and Conditions apply to all the services that are displayed on our Site, Acuity Scheduling or Stripe at the time the Client access it.

 

All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site, Acuity Scheduling or Stripe at your own risk.

 

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

 

Payments
 

All single lessons or group course must be fully paid 48 hours before the scheduled lesson/course start time.  All packaged multiple 1-to-1 lessons at a discounted rate ("Lesson Block") must be fully paid 48 hours before the first booked lesson of the block.  We reserve the right to cancel the booking if payment is not received by this timeframe.

We accept the following payment methods:

​

• Credit Card or other payment methods available via Acuity Scheduling or Stripe; and

• Bank Transfer (LLOYDS BANK (UK), ACCOUNT HOLDER: CHERRY LAM VOICE; SORT CODE: 30-54-66; ACCOUNT NUMBER: 52435468).

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel your booking.

 

Right to Cancel and Receive Refund
 

If you book and pay for a single 1-to-1 lesson, you have the right to cancel or reschedule the lesson provided that 48-hour notice is given to us prior to the lesson start time.  

​

If you pay for a Lesson Block:-

 

(i) you have the right to reschedule booked lessons provided that 48-hour notice is given to us prior to the lesson start time.  If you fail to give us the 48-hour notice, the booked lesson will be considered as attended.  No refund or reschedule will be allowed;

 

(ii) you have the right to cancel and request for refund for unused lessons within 14 days after confirmation of purchase ("the Initial 14-day Period).  However, you are still required to pay an amount which is in proportion to lessons attended or expected to be attended in the next 48 hours.  The refund amount will be the amount paid minus the number of lessson already attended or expected to be attended in the next 48 hours at the discounted rate; 

​

(iii) after the Initial 14-day Period, you may still request for a refund.  However, the refund amount will be the amount paid minus the number of lessons already attended or expected to be attended in the next 48 hours at the full rate of lesson as if they were single lessons booked at full rate; and 

​

(iv) all lessons must be booked and attended or request for refund must be received (according to clause (ii) and (iii) above) within six months after the date of purchase.  After six months, any unused amount will be forfeited and no refund will be issued. 

​

If you book and pay for a group course, you have the right to cancel and request for full refund 48 hours before the first lesson of the course.  You cannot cancel or request for refund, full or partial, after this time and once the course has started.  

​

We will make the reimbursement using the same form of payment as you used for the initial purchase unless you have expressly agreed otherwise.  You will not incur any fees because of the reimbursement. ​

​

Lateness or absence

​

If you are late for or absent from a scheduled lesson, the lesson will still finish at the scheduled lesson end time, and the lesson will still be considered as fully taken.  As stated above, we require 48-hour notice for non-attendance. 

 

If we/the teacher are late, you will still receive the full time of your lesson, during the lesson or at another agreed time.

Others

 

For in-person lessons conducted at our premises, it is compulsory for all Clients to provide an emergency contact in case of any safeguarding issues during training.

 

Lessons are held between us and you/the Client only. Under no circumstances are any guests or observers allowed in the lessons without permission from us and the Client. Parents/guardians may accompany a student of 12 years or under in the first lesson, if the student/parents/guardians would prefer it.

 

Recordings

​

Should we grant you permission to record any portion of the lesson (audio or video), these recordings are for your personal use only and that they will not be played, uploaded to web-based or social media, nor transcribed for anyone else.

​

Consumer Protection Law

Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

E. Limitation of Liability

Cherry Lam Voice and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

It is our mission to promote vocal health.  However, we make no claims nor guarantees.  You are solely responsible for the health of your voice.  You should seek the advice of a doctor such as a Laryngologist (an Ear-Nose-Throat doctor who specializes in voice) if you have any concern about your vocal health.  If you attend our lessons/training, you will notify us if you have ever been diagnosed with a voice disorder or if you suspect that you might have one.

F. Indemnity

Except where prohibited by law, by using this Site, Acuity Scheduling or Stripe, you indemnify and hold harmless Cherry Lam Voice and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

G. Applicable Law

These Terms and Conditions are governed by the laws of the Country of England.

H. Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

I. Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site, Acuity Scheduling or Stripe and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
